On September 24, 2015, a jury verdict was returned against ACI Worldwide Corp., a subsidiary of ACI Worldwide, Inc. (the Company), for $43.8 million in connection with counterclaims brought in a lawsuit involving BHMI, Inc. (BHMI) in the District Court of Douglas County, Nebraska. Previously, the Company had sued BHMI for the misappropriation of the Companys trade secrets in a jury trial, and the jury found that the Company had not met its burden of proof regarding these claims. BHMI then asserted counterclaims for breach of a non-disclosure agreement, tortious interference and violation of the Nebraska anti-monopoly statute, all of which were alleged to arise out of the Companys filing of its claim. On September 24, 2015, the jury found for BHMI on its three claims and awarded $43.8 million in damages. The court has yet to determine whether BHMI will be awarded any attorneys fees and costs. The Company disagrees with the results and intends to appeal the dismissal of the claims against BHMI and the verdict in favor of BHMI on its counterclaims.
