Franchise.Law Submits Comment for Virginia Retail Franchise Act, Effective January 2025

SCC Adopts Proposed Solution, Names Firm in Official Order

RICHMOND, VA / ACCESS Newswire / January 29, 2025 / The Virginia State Corporation Commission (SCC) has adopted a solution proposed by Franchise.Law in its recent amendments to the Virginia Retail Franchise Act, which took effect on January 1, 2025. After considering public comments on the proposed changes, the SCC named Franchise.Law and managing attorney, Jonathan Barber, in its official order.

Franchise.Law was the only party to submit public comments during the SCC's open feedback period. Representing franchisor clients, the firm voiced concerns and offered three proposals aimed at improving the revised regulations. The SCC officially adopted one of these recommendations and acknowledged Franchise.Law's contribution in its final order.

The Virginia Retail Franchise Act, which regulates how franchisors register and sell franchises within the Commonwealth, was recently revised with updates affecting the content and submission methods for franchise filings. Among the key changes is the introduction of a "Certification of Deferred Franchise Fee" form, designed for franchisors opting to defer franchise fees as a financial assurance measure.

"We are committed to ensuring franchise regulations support both compliance and business growth," said Jonathan Barber, managing attorney of Franchise.Law. "Contributing to this legislative update reflects our ongoing efforts to advocate for our clients' interests and help shape fair regulatory practices."

The updated Virginia Retail Franchise Act will impact franchisors seeking to register and operate within the Commonwealth beginning in 2025. The SCC continues to oversee the franchise registration process and regulatory compliance under the new rules.
