Court ruling allows DuraPlas’ antitrust claims to proceed while ensuring stable supply of PolarPad® products.
DuraPlas, a leading provider of innovative plastic solutions, announced today that a federal court ruling preserves its ability to challenge patent claims while safeguarding customer access to PolarPad® products.
The decision allows DuraPlas’ antitrust claims against DiversiTech to move forward and confirms that Version 2 of the PolarPad® remains unaffected by ongoing litigation. More than 93% of PolarPad® products in the market now use Version 2, ensuring continuity for customers.
“The court’s decision ensures our customers have uninterrupted access to PolarPad® and PolarPan® products while we continue driving innovation and protecting fair competition,” said Paul Phillips, President of DuraPlas. “This ruling is an important victory in our ongoing effort to ensure markets remain open and competitive, delivering choice, reliable supply, and high-quality products to our customers. Defending free and fair competition is a cause worth pursuing, and at DuraPlas, we are committed to fostering a transparent and equitable market that strengthens the industry and drives long-term innovation.”
The court also largely denied DiversiTech’s motion to dismiss DuraPlas’ antitrust claims, allowing the company to challenge exclusivity arrangements that may limit competition. DuraPlas has sought permission to file an amended complaint to include further allegations of anticompetitive conduct.
DuraPlas remains committed to advancing thermal management solutions that deliver reliability, choice, and industry-leading performance to customers worldwide.
