For example, many incorrectly assume they lose their rights if they leave the family home. But the founder of the Law Offices of Francis King said: "This common myth often comes up at a time when a client wishes to leave the family home during separation. They are often afraid to do so because they wrongly believe they would be giving up their share of the house equity. This is quite far from the truth."

He said a person who leaves does not waive any property ownership rights just because they no longer reside there. They will still be awarded their share as part of the final division of the overall estate. “However,” King said, “I usually discourage clients from moving out of the marital home while the divorce is pending, especially if he or she thinks she might want to return at a later time and keep the house after the divorce.”

Another common misconception is that spouses can never sell their house until the divorce is finalized. He said: "You can’t do it in the absence of a mutual agreement or a court order, but it is possible.”

Many are also under the false impression that alimony payments stop after an ex starts dating someone else. 

When asked to elaborate, King explained, "When a spouse receives alimony, they still can receive payments while dating someone else.  However, if they remarry, the alimony terminates.  It is also possible for the court to decide that cohabitation with a romantic partner will result in termination of alimony.”

One of the most widespread misconceptions is that the divorce process must always be long, drawn out and contentious. "Over the years, the word 'divorce' has gained negative connotations that evoke images of sitting in courtrooms and waging ugly and costly battles," King said. "In recent times, many of my clients have been able to avoid this through uncontested litigation, mediation, settlement conferences, or written negotiations."
