Hackensack, NJ Prescription Drug Lawyer Adam M. Lustberg Explains the Penalties for Violating Prescription Drug Laws in NJ

Hackensack, NJ prescription drug lawyer Adam M. Lustberg releases a new article (https://www.lustberglaw.com/drug-crimes/prescription-drug-offenses-lawyer/) that explains the penalties for violating prescription drug laws in New Jersey. The lawyer mentions that if someone has been charged with possession of a prescription drug without a valid prescription, the penalties will depend upon the dosage units that are possessed.

“It is a crime to possess prescription drugs that were not prescribed by a medical professional or to distribute even legally prescribed drugs to other persons without a valid medical license. In New Jersey, an individual can face criminal charges for unlawful possession, possession for sale, trafficking, manufacturing, or distribution of a prescription drug,” says the Hackensack, NJ prescription drug lawyer.

The lawyer explains that there is an epidemic of opioid abuse in the USA today. The New Jersey legal system is making a serious effort to stop prescription drug abuse, forgery, fraud, and “doctor shopping.” Since there are many addictive narcotic prescriptions entering the marketplace, the opportunities for illegal prescription drug use and abuse are also increasing.

Attorney Adam M. Lustberg says that oftentimes, prescription drug addiction begins innocently when a patient is legally prescribed a narcotic such as Xanax or Vicodin and becomes addicted to it. After the duration of the prescription is over, the patient may try to illegally obtain the drug. Doctor shopping is one illegal conduct that includes the patient changing doctors to obtain a narcotic prescription.

In the article, attorney Lustberg says that if someone is charged with knowingly possessing a prescription drug without a valid prescription, they will be charged with a disorderly person's offense. If they are convicted, the penalty is up to six months in prison and $1,000 in fines. It will be a felony crime if someone is found with four or fewer units of prescription drugs.

According to attorney Adam M. Lustberg, “If you are a first-time offender charged with a fourth-degree crime in New Jersey, you may be eligible for pretrial intervention (PTI), drug court, or a diversionary program in which the charges can be dismissed if you successfully complete a period of temporary probation. If you illegally possessed 5-100 prescription drug units, the penalties include 3-5 years in NJ state prison and a fine of up to $200,000.”

Lastly, the lawyer emphasizes the importance of having a skilled defense lawyer when facing charges of possession of a prescription drug without a valid prescription. An experienced lawyer may be able to help the defendant protect their rights and freedom.
